1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you" or "Customer") and Fusionaly ("we", "us", or "our"), concerning your access to and use of the fusionaly.com website as well as our self-hosted analytics software.

By purchasing, downloading, installing, or using the Service, you agree to be bound by these Terms.

2. The Service: Self-Hosted Software

Fusionaly provides self-hosted web analytics software. This means you download, install, configure, and run the software on your own server infrastructure. You are responsible for providing and managing the necessary hosting environment.

We provide the software license; you control its operation and the data it collects. We do not access, store, or process your End User Data.

3. License Grant

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to:

  • Install and run Fusionaly on your servers.
  • Collect analytics data from websites you own or have permission to operate.

Updates: Your license includes updates released within one year after purchase. Major future versions may require an additional purchase.

4. Payments and Guarantee

Access to the Service requires a one-time license purchase fee. All payments are processed through Polar.

5. Support

Fusionaly Pro includes email support. I'm a solo developer building this product. I'll respond as quickly as I can, usually within a few business days.

No SLA. There are no guaranteed response times. If you need enterprise-level support with formal commitments, this isn't the right fit.

6. Restrictions on Use

You must not:

  • Sell, rent, lease, sublicense, or redistribute the Service.
  • Reverse-engineer, decompile, or disassemble the software.
  • Modify or create derivative works without written consent.
  • Use the Service in violation of any applicable laws.
  • Remove copyright notices or proprietary rights notices.
  • Circumvent license verification mechanisms.

7. Customer Responsibilities

As the operator of a self-hosted service, you're responsible for:

  • Providing and securing the server infrastructure.
  • Installing, configuring, and maintaining the software.
  • Ensuring security of collected End User Data.
  • Complying with all applicable privacy laws (GDPR, CCPA, etc.).
  • Creating your own privacy policy.
  • Implementing data backups and disaster recovery.

8. Limitation of Liability

To the maximum extent permitted by law, Fusionaly will not be liable for:

  • Direct, indirect, incidental, or consequential damages.
  • Lost profits, revenue, data, or business opportunities.
  • Security breaches, data loss, or corruption.
  • Downtime or service unavailability.
  • Issues caused by improper configuration or usage.

9. Disclaimer of Warranties

Fusionaly is provided "as is" and "as available." We expressly disclaim all warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.
